PREAMBLE

GENERAL TERMS AND CONDITIONS OF SALE applicable to consumers on the websitewww.sergeblanco.comas of March 15, 2009

These general terms and conditions of sale govern all sales made by our Company to consumers purchasing for their personal needs on our commercial website (the Customer).

Any special requirements of the Customer shall in no case be enforceable against the Company if they have not been previously accepted in writing by the Company.

As the Company may occasionally modify certain provisions of its general terms and conditions of sale, it is necessary to read them before each order on its website. These modifications are enforceable as soon as they are posted online and cannot be applied to contracts concluded previously. Orders placed on the website are governed by the general terms and conditions of sale applicable on the date of the order.

By confirming the order and ticking the box "I certify that I have read and accepted the general terms and conditions of sale of "www.sergeblanco.com", the Customer expressly accepts these terms and conditions.

The total or partial invalidity of any of the clauses below shall not affect the validity of the other clauses.
 

1 – ORDERS

The Company's acceptance of the Customer's order is confirmed by sending an order confirmation email.

The Company reserves the right not to accept an order for a legitimate reason, for example: stock depletion, difficulty in sourcing a product, foreseeable problems with delivery, or an abnormal order.

In particular, any order for small quantities or any new order from a Customer with whom there is a dispute relating to the payment of a previous order will be considered abnormal. In the event that an order is not accepted, the company will inform the Customer by any means.

INTERNET CUSTOMER SERVICE: the execution of the order can be tracked by contacting customer service at the following address: 0806 110 015 (no surcharge) from 10 a.m. to 12 p.m. and from 1 p.m. to 5 p.m. Monday to Thursday and until 4 p.m. on Friday, or on the website in the "My Account" section.

2 – CANCELLATION

Except in the case of exercising the right of withdrawal referred to below, orders cannot be canceled without the prior written consent of the Company.

In any event, no cancellation for any reason whatsoever will be accepted for an order that is currently being processed.

3 – PRICE

Prices are quoted in euros, inclusive of all taxes and excluding delivery costs, which remain the responsibility of the Customer. Delivery costs are indicated when the order is placed.

Products are invoiced based on the prices and VAT rate in effect at the time of ordering.

As an e-commerce business, we are very responsive in adjusting our prices according to fashion trends, stock levels, and our commercial operations.
Our prices may also change due to promotions or sales. The price difference for orders placed before promotions or sales cannot be refunded.

Some products are carried over from one season to the next, and the prices displayed may change depending on offers or increases in raw material prices. Our commercial policy is therefore applied at the time of purchase and at the price indicated.

A discount code can only be used on a single order. No refund will be made solely on the grounds of forgetting to enter a discount code at the time of ordering.

All special commercial operations are valid for a limited period, while stocks last, and cannot be combined with other current offers.

4 – DELIVERIES

Deliveries are made to the address indicated on the order.

Except in cases of force majeure, the delivery time for all orders over €500 including tax (mainland France) is a maximum of 30 days from the date of order. Failure to deliver within the specified time frame will result in a refund of the price paid for the order after the goods have been returned, to the exclusion of any other compensation or damages.

For deliveries not exceeding €500 including tax, the Company declines all responsibility in the event of late delivery. No delay in delivery shall entitle the Customer to cancel the sale, refuse the goods, or claim damages, unless the Customer can demonstrate that they have suffered a loss.

The Company reserves the right to make partial deliveries of the total order depending on the possibilities at the time.
The Company reserves the right to choose the carrier.
All transport risks are borne by the Customer from the moment the goods leave the warehouse.
The recipient who takes delivery of the goods is responsible for checking their condition on arrival, so that in the event of damage, any recourse against the carrier can be exercised the day after receipt of the products by registered letter with acknowledgment of receipt.

Any dispute in which the Customer has not complied with these conditions will not be taken into consideration.

Delivery methods: 

Delivery to a pickup point via DPD is available for orders to mainland France. Delivery time is between 2 and 5 business days, depending on the opening hours of the pickup point selected by the customer when placing their order. Delivery to a pickup point is free for purchases over €80 in mainland France. 

Express delivery to a pick-up point via Chronopost valid for orders to mainland France. Delivery time of 24 working hours from dispatch, depending on the opening hours of the pick-up point selected by the customer when placing their order. 

Delivery via DPD valid for orders to mainland France. Delivery time of 2 to 5 business days. Standard home delivery is free for all orders over €120 to mainland France.

Express delivery via Chronopost for orders to mainland France. Delivery time of 24 working hours from dispatch.

Home delivery via DHL for orders to countries in Europe and worldwide. Delivery time of 2 to 5 working days, depending on the destination. Home delivery via DHL is free for orders above a minimum purchase amount, depending on the destination.

sergeblanco.com makes every effort to ship purchases within two (2) business days of receiving your order, after verification and bank authorization.

For all export orders, delivery is handled by DHL. Delivery costs are calculated based on the destination country. Customs duties and additional shipping costs are the responsibility of the customer.
 

5 – NON-COMPLIANCE

In the event of a complaint regarding the quality of the goods delivered, the Company's liability is strictly limited to the obligation to replace or refund these goods, to the exclusion of any damages.
No goods may be returned without the prior written consent of the Company.
Underwear (boxer shorts and socks) and perfumes cannot be returned.

A printable return label is available (15 days after receipt of the package) in your personal account to be affixed to the goods to be returned to the Company.
Returns from abroad are at the customer's expense.
The Receiving Department will only accept packages bearing this label. Only prepaid returns will be accepted.

Upon receipt and inspection of the return, a credit note will be issued or the returned goods will be refunded by crediting the purchase price to your account via your payment method within a maximum of 30 days following receipt of the returned items. A credit note on your sergeblanco.com customer account will be valid for one year.

Items ordered on the www.sergeblanco.com website cannot be exchanged or refunded in SERGE BLANCO stores.
The return of defective products is at the customer's expense and risk, unless the deadline does not exceed 15 days after receipt of the package. Please contact Customer Service by sending an email to contact@sergeblanco.com, explaining your request. Customer Service will then inform you of the applicable procedure.

6 – CONSUMER RIGHT OF WITHDRAWAL AND RETURNS

In accordance with the Consumer Code, the Customer has a withdrawal period of fourteen (14) days from delivery. Within this period, the Customer may:

  • request a free exchange: only for the same item in a different size. The prepaid return/exchange label provided by the Company must be affixed to the package; no fees will be charged;

  • request a full refund: the customer is responsible for the return shipping costs. A return label (€9.90) can be generated from the Customer Area; this amount will be deducted from the refund;

  • Request a store credit refund: in the form of a credit valid for three (3) months on the website www.sergeblanco.com. In this case, no return shipping fees will be charged.

Items must be returned in their original packaging, labeled, in perfect condition, unworn, unwashed, complete, and accompanied by a copy of the invoice and the return form included in the package. It is the Customer's responsibility to retain proof of return (registered mail or proof of deposit with a specific date). The Receiving Department will only accept packages bearing the return label provided.

No returns will be accepted after 14 days following delivery.

Reimbursement terms and conditions

  • In the event of a full refund, the amount of the returned items will be credited back to the payment method used when placing the order, within a maximum of thirty (30) days following receipt of the items, minus €9.90 for return shipping costs .

  • In the event of a refund in the form of a credit note, the full price of the items will be credited to the Customer's account, with no fees deducted.

  • The initial shipping costs are not refunded, unless the item received does not correspond to the order (preparation error) or if the product is defective, in which case the Company will also cover the full cost of delivery.

No refunds will be given for worn, incomplete, or damaged clothing.

The Company may issue reservations on the right of withdrawal in accordance with Article L.121-20-2 of the Consumer Code, in particular for products manufactured according to the Customer's specifications or clearly personalized. Products are returned under the full responsibility of the Customer. In the event of a dispute, damaged products will be deducted from the amount refunded and kept at the Customer's disposal.

Returned items that comply with the terms and conditions will, depending on the Customer's initial choice, be exchanged free of charge, refunded (fee of €9.90), or refunded in the form of a credit note at no cost.

Items ordered on the websites www.sergeblanco.com and cannot be exchanged or refunded in SERGE BLANCO stores. When returned items are part of an order that entitled the customer to a gift linked to the purchase amount, said gift must be returned with the merchandise; otherwise, its sale price will be deducted from the refund.

7 - PAYMENT TERMS

The Company only accepts payments by credit card (CB, Visa, or Mastercard) or via PayPal: the amount indicated on the invoice will be debited the day after the order date, provided that authorization to debit the Customer's account has been obtained in advance from the relevant payment centers, failing which the order cannot be processed.

Online payment by credit card is made via the Merc@net security system of BNP PARIBAS or via Kwixo of CREDIT AGRICOLE. This system is SSL-secured if the merchant server has an SSL certificate, or uses encrypted keys provided by BNP PARIBAS to encrypt bank details when they are transmitted over the network.

The order is automatically canceled if payment is not received in full.
By express agreement, any invoice subject to dispute may be increased by 15%.

8 – WARRANTIES

La Société (société TNT SERGE BLANCO sis 27, avenue Marcel DASSAULT, 31500 TOULOUSE) est garante de la conformité des produits et des défauts de conformité dans les conditions de l’article L 211-4 et suivants du Code de la consommation, et des défauts cachés dans les conditions prévues aux articles 1641 et suivants du Code civil.
Lorsqu’il agit en garantie légale de conformité, le Client :

- bénéficie d’un délai de 2 ans à compter de la délivrance du bien pour agir ;
- peut choisir entre la réparation ou le remplacement du bien, sous réserve des conditions de coût prévues par l’article L 211-9 du Code de la consommation ;
- est dispensé de rapporter la preuve de l’existence du défaut de conformité du bien durant les 6 mois suivant la délivrance du bien (délai porté à 24 mois à compter du 18 mars 2016 pour les biens achetés neufs).

La garantie légale de conformité s’applique indépendamment de la garantie commerciale éventuellement consentie par la Société.
Le Client peut décider de mettre en œuvre la garantie contre les défauts cachés du produit vendu prévue à l’article 1641 du Code civil et, dans cette hypothèse, il peut choisir entre la résolution de la vente ou une réduction du prix de vente conformément à l’article 1644 du Code civil.

Garantie légale de conformité (Article L 211-1 et suivants du code de la consommation)
Article L 211-4 du code de la consommation

Le vendeur est tenu de livrer un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. Il répond également des défauts de conformité résultant de l´emballage, des instructions de montage ou de l´installation, lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.
 Article L 211-5 du code de la consommation

Pour être conforme au contrat, le bien doit :
1° Etre propre à l´usage habituellement attendu d´un bien semblable et, le cas échéant :
- correspondre à la description donnée par le vendeur et posséder les qualités que celui-ci a présentées à l´acheteur sous forme d´échantillon ou de modèle ;
- présenter les qualités qu´un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l´étiquetage ;
2° Ou présenter les caractéristiques définies d´un commun accord par les parties ou être propre à tout usage spécial recherché par l´acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.

Article L 211-6 du code de la consommation
Le vendeur n´est pas tenu par les déclarations publiques du producteur ou de son représentant s´il est établi qu´il ne les connaissait pas et n´était pas légitimement en mesure de les connaître.

Article L 211-7 du code de la consommation
Les défauts de conformité qui apparaissent dans un délai de six mois à partir de la délivrance du bien sont présumés exister au moment de la délivrance, sauf preuve contraire.
Le vendeur peut combattre cette présomption si celle-ci n´est pas compatible avec la nature du bien ou le défaut de conformité invoqué.

Article L 211-8 du code de la consommation
L´acheteur est en droit d´exiger la conformité du bien au contrat. Il ne peut cependant contester la conformité en invoquant un défaut qu´il connaissait ou ne pouvait ignorer lorsqu´il a contracté. Il en va de même lorsque le défaut a son origine dans les matériaux qu´il a lui même fournis.

Article L 211-9 du code de la consommation
En cas de défaut de conformité, l´acheteur choisit entre la réparation et le remplacement du bien.
Toutefois, le vendeur peut ne pas procéder selon le choix de l´acheteur si ce choix entraîne un coût manifestement disproportionné au regard de l´autre modalité, compte tenu de la valeur du bien ou de l´importance du défaut. Il est alors tenu de procéder, sauf impossibilité, selon la modalité non choisie par l´acheteur.

Article L 211-10 du code la consommation
Si la réparation et le remplacement du bien sont impossibles, l´acheteur peut rendre le bien et se faire restituer le prix ou garder le bien et se faire rendre une partie du prix.

La même faculté lui est ouverte :
1° Si la solution demandée, proposée ou convenue en application de l´article L 211-9 ne peut être mise en œuvre dans le délai d´un mois suivant la réclamation de l´acheteur ;
2° Ou si cette solution ne peut l´être sans inconvénient majeur pour celui-ci compte tenu de la nature du bien et de l´usage qu´il recherche.
La résolution de la vente ne peut toutefois être prononcée si le défaut de conformité le défaut est mineur.

Article L 211-11 du code de la consommation
L´application des dispositions des articles L 211-9 et L 211-10 a lieu sans aucun frais pour l´acheteur.
Ces mêmes dispositions ne font pas obstacle à l´allocation de dommages et intérêts.

Article L 211-12 du code de la consommation
L´action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.
Garantie des vices cachés (articles 1641 à 1649 du code civil)

Article 1641 du code civil
Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l´usage auquel on la destine, ou qui diminuent tellement cet usage que l´acheteur ne l´aurait pas acquise, ou n´en aurait donné qu´un moindre prix, s´il les avait connus.

Article 1642 du code civil
Le vendeur n´est pas tenu des vices apparents et dont l´acheteur a pu se convaincre lui-même.

Article 1643 du code civil
Il est tenu des vices cachés, quand même il ne les aurait pas connus, à moins que, dans ce cas, il n´ait stipulé qu´il ne sera obligé à aucune garantie.

Article 1644 du code civil
Dans le cas des articles 1641 et 1643, l´acheteur a le choix de rendre la chose et de se faire restituer le prix, ou de garder la chose et de se faire rendre une partie du prix, telle qu´elle sera arbitrée par experts.

Article 1645 du code civil
Si le vendeur connaissait les vices de la chose, il est tenu, outre la restitution du prix qu´il en a reçu, de tous les dommages et intérêts.

Article 1646 du code civil
Si le vendeur ignorait les vices de la chose, il ne sera tenu qu´à la restitution du prix, et à rembourser à l´acquéreur les frais occasionnés par la vente.

Article 1647 du code civil
Si la chose qui avait des vices à péri par suite de sa mauvaise qualité, la perte est pour le vendeur, qui sera tenu envers l´acheteur à la restitution du prix et aux autres dédommagements expliqués dans les deux articles précédents.
Mais la perte arrivée par cas fortuit sera pour le compte de l´acheteur.

Article 1648 alinéa 1er du code civil
L´action résultant des vices rédhibitoires doit être intentée par l´acquéreur dans un délai de deux ans à compter de la découverte du vice.

9 - INTELLECTUAL PROPERTY

As such, and in accordance with the provisions of the Intellectual Property Code, only private use is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any total or partial reproduction of the sergeblanco.com website is strictly prohibited without prior agreement.

10 – PROTECTION OF PERSONAL DATA

Personal information provided by the Customer is reserved for internal use by the company, which undertakes to comply with the provisions of the French Data Protection Act No. 78-17 of January 6, 1978. The company implements optimal security measures against the loss, misuse, and alteration of the information entrusted to it.

Personal data collected on the website may be communicated, with the customer's consent, to our partners for the exclusive purpose of operating the website.

This data will only be communicated externally other than as provided above in order to comply with legal and regulatory obligations, or at the request of an administrative or judicial authority.

The site uses cookies as a means of recognition during visits. These cookies do not contain any personally identifiable information. Cookies must be enabled in order to use the site.

The automated processing of personal data carried out from the website has been declared to the French Data Protection Authority (CNIL) under receipt no. 1344020.

11 – APPLICABLE LAW

The law applicable to this contract between the Company and the Customer is French law.

12 – OFFERS

REFERRAL OFFER: The €10 referral offer (€10 for the referred friend and €10 for the referrer) is reserved for sergeblanco.com customers.
The referral's voucher is valid for 60 days after receipt, and the referrer's voucher is valid for 90 days after receipt.
Each entry must be linked to a unique IP address. These conditions will result in the cancellation of the referral: similar IP addresses between the referrer and the referral, self-referrals, and similar email addresses.
The Company reserves the right, whenever necessary, to take all reasonable measures to protect itself from fraud, including verifying more precisely the identity, age, or any other information concerning a customer.
Gift cards can be used when placing orders on the sergeblanco.com website by entering the promotional code received by email or generated in your customer account in the "discount code" field on the shopping cart page. These gift cards cannot be combined with each other or with other gift cards.


BIRTHDAY OFFER: Customers can receive a discount on their next order on their birthday. A promotional code is emailed to customers once a year, provided they are subscribed to the newsletter. This offer is not retroactive. If the customer does not apply the code before placing their order, the discount will not be applied retroactively. The birthday offer cannot be combined with discounted or outlet products.

TIME CHANGE OFFER: Orders placed on the sergeblanco.com online store between midnight and 6 a.m. on the night of Saturday, March 28, to Sunday, March 29, 2026, will be 100% refunded in the form of a gift card. The gift card covers the total amount of the order. Any discounts applied to the order at the time of purchase (discounts, coupons, and gift cards) will be deducted; only the amount actually paid by the customer will be taken into account. Participation is confirmed once the withdrawal period has expired, i.e., 14 days from receipt of the order. Gift cards will be sent via email on April 15, 2026, will be valid from April 15, 2026, through May 3, 2026, inclusive, and will expire permanently after that date. They are usable only on the sergeblanco.com online store, are non-transferable, and can be combined with current promotional offers. The seller cannot be held responsible if the email containing the gift card ends up in the recipient’s SPAM folder; we encourage you to check this folder starting April 15, 2026. Excluded are all items in an order for which a return request has been made, whether for a refund to the original payment method or a store credit. Only exchanges will be accepted; however, if the new exchange order is canceled due to lack of available stock, the value of the item will be refunded and thus deducted from the original order. All items in an order that have been fully or partially canceled—whether at the customer’s initiative or the seller’s (due to lack of stock)—will be excluded from the offer.



PARTY SHIRT OFFER: The "buy 2 shirts, get 1 free" offer is valid until February 28, 2025, on full purchases. In the event of a return or partial cancellation (concerning one or two shirts), the refund amount will be calculated on a pro rata basis of the original price, and the customer will not be able to keep the benefit of the offer.

13 - EXTENDED PRODUCER RESPONSIBILITY (EPR)

Under the new AGEC regulations, effective January 1, 2022, companies subject to the Extended Producer Responsibility (EPR) principle must have a unique identification number issued by ADEME (the French Environment and Energy Management Agency) in accordance with the provisions of the Anti-Waste for a Circular Economy (AGEC) law. In compliance with the law and the values it promotes, SERGE BLANCO is pleased to join the waste management organization Adelphe and thus guarantee its commitment through its unique identifier in the packaging sector: FR219103_01DUXL.
